Royal Assent began the next stage of Employment Rights implementation

The Employment Rights Act received Royal Assent in December 2025, with reforms taking effect in stages. Employers needed a programme that distinguished enacted provisions from commenced measures and connected each approved change to everyday recruitment processes.

An Act with staged commencement

The government’s Royal Assent announcement described reforms covering sick pay, family leave, insecure work and other employment protections, with implementation over a period rather than one universal start date. The Act’s commencement provisions and subsequent regulations determined when particular measures operated.

That distinction prevented a common communication error: saying a reform was already available simply because it appeared in the Act. Employers needed to separate enacted provisions from commenced rights and then check the applicable detail. A current legal question could not be answered solely by quoting the December press release.

Map the changes across the recruitment lifecycle

Some changes affected information collected before a start, while others affected absence, assignment management or ongoing employment administration. A recruitment operation needed a map of affected forms and handovers, rather than a disconnected collection of policy announcements. Each process also needed a person authorised to approve the required change.

Historical versions should be retained according to the employer’s records policy so that later reviews can identify what applied at a particular time. At the same time, routine users need a clearly marked current version. An archive folder without a release process can leave obsolete wording in everyday use.

Before a change is marked complete, ask the relevant coordinator to demonstrate the updated handover using a sample record, without entering real sensitive information.

Make implementation reviewable

Key Med Solutions can support an inventory of recruitment documents, maintain an approved implementation tracker and coordinate updates across onboarding, candidate communication and back-office tasks. The employer’s legal, HR and payroll advisers should determine requirements and approve the content before it is released.

A useful tracker shows the authoritative source, commencement status, affected process, decision owner and outstanding action. Completion should mean that the relevant team can use the approved change, not merely that a draft policy exists. Any unanswered legal question should stay visible rather than being converted into an administrative assumption.

The December 2025 lesson is to treat Royal Assent as a major milestone within a continuing programme. Key Med can provide the research and operational coordination that keeps the work organised. Employers and qualified advisers retain responsibility for interpretation, employment decisions and checking later commencement updates.
