Employment & immigration — The explainer

English-language evidence needed a clear owner in January 2026

New Skilled Worker applicants generally faced an English-language change from January 2026, with transitional distinctions. Recruiters needed an approved evidence request and adviser-led assessment rather than assumptions based on nationality, job title or previous UK work.

The January requirement and its distinctions

Home Office guidance states that the Skilled Worker requirement is normally B2 in reading, writing, speaking and listening. Applicants whose relevant previous Skilled Worker permission was subject to B1 can fall within transitional arrangements. The precise rules and permitted ways to demonstrate English need to be checked for the individual application.

This is distinct from an employer’s assessment of communication skills for a role and from any professional-registration requirement. Passing an interview does not, by itself, establish immigration eligibility. Conversely, a recruiter should not impose an improvised test and describe it as an official substitute for the evidence required by the route.

Ask for the right evidence without making assumptions

A candidate may already have an approved form of evidence or may need advice about what is acceptable. Repeatedly asking for unrelated certificates can create confusion and unnecessary delay. Recruitment administrators should work from the sponsor’s authorised checklist and send questions about exemptions, qualifications or previous permission to the appropriate adviser.

The records should also distinguish evidence received from evidence reviewed. A document attached to a candidate profile is not the same thing as an authorised decision that it meets a requirement. That distinction matters when an interview coordinator or hiring manager is checking whether a proposed start remains realistic.

A document request should explain its approved purpose and identify where the candidate can direct a question about the requirement.

Keep coordination separate from assessment

Key Med Solutions can assist with maintaining an employer-approved document checklist, tracking outstanding items and coordinating candidate updates. The sponsor and authorised immigration adviser should determine what evidence is required and whether it is sufficient. Support staff should not interpret a candidate’s nationality or accent as evidence for or against eligibility.

Within healthcare-led recruitment, a structured record can keep immigration evidence separate from employer assessments and professional-registration checks. Each has its own owner and status. Sensitive documents should be shared only with authorised recipients, and duplicate requests should be reconciled before another message is sent.

The January 2026 lesson is to make evidence handling precise and respectful. Key Med can support the administration and candidate communication around an approved process. Personal immigration advice, decisions about exemptions and any sponsorship assessment remain with appropriately authorised professionals and the employer.
