The code’s emphasis on consultation
The code set out responsibilities for employers seeking contractual changes and aimed to make dismissal and re-engagement a last resort. Employment tribunals could increase relevant compensation by up to 25% where an employer unreasonably failed to comply. It was a code governing conduct, rather than a simple blanket prohibition on changing contracts.
The historical position should be kept separate from later Employment Rights Act measures and their commencement. A July 2024 article cannot establish what applies to a current restructuring. Employers considering contractual change need advice on the circumstances, consultation requirements and the rules in force at the relevant time.
A proposal is not an agreed contract
A hiring manager might circulate proposed hours or pay during a wider organisational review. If those figures reach an applicant-tracking system without a clear status, a recruiter can inadvertently describe them as agreed. Candidates then receive inconsistent information, and existing employees may learn about a proposal through an external advert.
A practical control is to distinguish draft, under consultation, approved and effective versions. Each should have a responsible owner and permitted use. Access also matters: a recruitment coordinator may need the approved outcome but not the full contents of a confidential employment discussion.
A release checklist should confirm that the authorised terms appear consistently in the advert, interview briefing and offer instructions before candidate communication resumes.
Keep records in the authorised sequence
Key Med Solutions can help maintain a client-approved document register, pause outdated adverts and ensure offer coordinators use the version authorised by the employer. Any substantive decision about contract changes, dismissal or consultation remains with the client and its employment advisers.
When approved terms change, the handover should identify the effective date, affected roles and communication instructions. A status check before a new advert or offer is issued can catch an old template. Exceptions should return to the decision-maker rather than being resolved by whichever administrator is closest to the deadline.
The July 2024 lesson is that version control supports fair communication. It cannot make an improper process lawful, but it can prevent administration from undermining an employer’s agreed sequence. Key Med’s contribution can be tracking, coordination and document updates within a clearly authorised remit.
