The announcement and its implementation date
The announcement said care providers seeking a new worker from overseas would first have to show that they had attempted to recruit a worker within England who needed new sponsorship. The rules were laid on 12 March and were to operate from 9 April 2025. Announcement and commencement were separate dates.
Later July 2025 changes closed new overseas entry-clearance applications for care workers and senior care workers and changed the surrounding requirements. The April priority rule must therefore be read as a historical stage, not promoted as an unchanged instruction for a new recruitment exercise today.
The order of the search mattered
A recruitment team could not demonstrate an earlier search simply by adding a retrospective note after an overseas candidate had been selected. The operational challenge was to plan the relevant contact, search and review steps in the right order, following the sponsor’s approved instructions and applicable guidance.
Candidate care also mattered. A displaced worker may have experienced uncertainty after an employer’s sponsorship difficulties. Communications should explain the genuine vacancy, employer and next steps without promising a visa outcome. Recruiters should record skills and availability accurately while avoiding unnecessary circulation of personal immigration documents.
The activity log should distinguish a genuine candidate conversation from an automated message, giving the employer a more useful account of the search undertaken.
Keep the sponsor-led record coherent
Key Med Solutions can help organise a client-approved search plan, maintain contact and activity records, and coordinate interviews with workers identified through appropriate channels. The sponsor and its authorised advisers should determine the applicable requirements and assess whether an individual can be sponsored.
A useful review pack distinguishes candidates contacted, candidates interested, candidates assessed against the actual role and decisions made by the employer. Reasons should be factual and relevant, rather than boilerplate wording designed to create an appearance of activity. Recruitment administration works best when the underlying vacancy and assessment are genuine.
The lesson from March 2025 is to change the workflow when policy changes the order of a search. Key Med can provide research, candidate engagement and administration around that workflow. It does not act as a visa sponsor or make personal immigration decisions, and later rules need to be checked before the process is reused.
