Employment & immigration — The explainer

Sponsorship-cost rules needed a trail through invoices and agreements

Restrictions on recovering specified sponsorship costs from workers expanded in April 2025. Employers needed to review how costs appeared across payments, invoices and repayment wording, with specialist assessment retained for questions about the relevant rules.

The specified costs covered by the rules

Home Office sponsor guidance treats recovery or attempted recovery of specified sponsor-licence and Certificate of Sponsorship charges, and associated administrative costs, as grounds for revocation in the relevant circumstances. Skilled Worker restrictions applied from 31 December 2024; further route-specific restrictions applied from 9 April 2025.

The details depend on the charge, route and relevant date. This does not mean every expense connected with a visa is governed by an identical rule. Employers should have an authorised immigration adviser review the applicable provisions and any repayment wording, rather than letting an administrator decide which costs can be passed on.

Follow the cost through the records

An employer may have a supplier invoice, a relocation spreadsheet, an offer document and a proposed deduction instruction referring to the same expenditure. If only one is corrected, an older description can continue through another channel. Generic labels such as administration fee can also make it difficult to identify what the payment actually represents.

A useful review links each payment to its purpose, payer, recipient and approval. It should distinguish an invoice awaiting review from a cost authorised for a particular treatment. Staff should not assume that a signed repayment agreement makes a prohibited recovery permissible.

A sample review can follow one charge from invoice to final payment instruction, checking whether each record describes the same underlying cost.

Prepare a reviewable administrative trail

Key Med Solutions can help assemble a cost register, identify duplicate or unclear descriptions and route documents to the client’s designated adviser. After the employer approves changes, support staff can update templates and flag outstanding records. The process should make the legal reviewer visible rather than implying that finance administration supplies immigration advice.

For recruitment teams, approved communications should explain the employer’s arrangements accurately and avoid ad hoc promises about deductions or reimbursements. Questions from candidates need a clear response owner. A consultant should not improvise a new repayment term to solve a late commercial disagreement.

The April 2025 lesson is to follow the cost through the entire process. Key Med can provide document organisation, reconciliation and coordination. The sponsor remains responsible for its duties, and authorised professional advice is needed on the legality of a particular payment or recovery arrangement.
