The Fair Work Agency launch made a coherent record more useful

The Fair Work Agency launched in April 2026 with a transitional year ahead. Recruitment businesses needed to understand which functions were active and organise their records without assuming that every responsibility had transferred on launch day.

The launch and the transition

The new agency brought together work previously associated with the Employment Agency Standards Inspectorate, Gangmasters and Labour Abuse Authority and Director of Labour Market Enforcement. Its first-year strategic steer described the transition. National Minimum Wage enforcement continued to be delivered by HMRC under an arrangement with the agency during 2026–27.

Later transfer and expansion plans had their own timetable. The delivery plan described preparation for the April 2027 transfer of National Minimum Wage colleagues and future holiday-pay enforcement. Those plans should not be reported as completed April 2026 events. The relevant enforcement route and jurisdiction still needed to be checked.

Fragmented records are harder to explain together

An employment business may hold a client agreement in one system, assignment information in another and worker communications in individual inboxes. Each record can appear adequate on its own while the overall sequence remains hard to explain. A useful review asks whether the business can reconstruct what was agreed and what actually happened.

That is especially relevant when several providers support the same recruitment process. Contracting out a task should not leave uncertainty about who owns the underlying decision or evidence. A defined operational remit and clear record locations make it easier for the client to understand the work it remains responsible for.

A sample assignment review can test whether each handover has an identifiable owner before the business attempts a larger records exercise.

Prepare an operational record with clear ownership

Key Med Solutions can help map a client-approved process, identify missing handover records and organise an exception register. The review should begin with existing obligations and the client’s professional advice, rather than inventing a compliance badge or claiming that a tidy folder proves legal compliance.

An agreed record map can identify each document’s owner, location, access restrictions and link to the relevant assignment. Open issues should have a next action and accountable contact. This can help an employer prepare a coherent response to an internal review without encouraging indiscriminate collection of sensitive information.

The April 2026 lesson is to understand both the regulator’s phased development and the business’s own evidence trail. Key Med can support administration, reconciliation and research, while employers and employment businesses retain their legal responsibilities and obtain qualified advice on regulatory questions.
