The penalty change in February
The updated code set a starting point of £45,000 per illegal worker for a first breach and £60,000 for a repeat breach within three years, before applicable reductions. The actual outcome depended on the circumstances and mitigating factors. It was not a flat automatic fine for every missing document.
The employer’s statutory excuse depends on carrying out the prescribed checks correctly. A general identity check or a copy supplied by a recruiter should not be assumed to provide the same result. This retrospective addresses process organisation; individual right-to-work questions require the relevant Home Office guidance and, where necessary, specialist advice.
What sits behind a completed status field?
A record marked complete can hide important questions: which checking route was used, who performed it, where the result is stored and whether a follow-up is needed. Recruitment coordinators need enough structure to route an unresolved case before a start date, rather than discovering the uncertainty when a client asks for evidence.
Consistency is equally important. Nationality, name or appearance should not determine whether a person faces additional informal hurdles. A standard process needs an escalation path for applicants whose circumstances require another permitted checking route, rather than encouraging administrators to invent their own shortcuts or exclusions.
A start-date dashboard should show unresolved checks separately from ordinary onboarding paperwork, so urgency does not disappear inside a long general task list.
Make the evidence and owner visible
Key Med Solutions can help organise a client-approved onboarding workflow, chase outstanding information and maintain a queue of cases awaiting the employer’s review. The scope should specify who conducts the required check and who authorises the start. Support staff should not certify a legal conclusion beyond their agreed authority.
An exception report can separate missing evidence, pending review and future follow-up dates. Each item should have an owner and a next action. Sensitive documents need controlled access and retention instructions; placing everything in an unrestricted shared folder is not a sound substitute for a defined evidence process.
The February 2024 change reinforced the value of auditable handovers. Key Med can provide coordination and recordkeeping around the employer’s process, while the employer retains its legal responsibilities. The aim is to make unresolved work visible, not to suggest that outsourcing administration transfers the statutory duty.
